Capt. L.R. Peyton was killed by Sgt. Edwin Young Co. A 2nd New Hampshire Volunteers on the day of his arrival at Pt. Lookout. From the board of inquiry conducted March 22, 1864 Sgt. Young testimony…

"In the course of my duties I was called on last Sunday to assist in providing some prisoners who had just arrived with tent accommodations… I was addressed by Capt. Peyton who said" you are a fit subject to be here" and asked me which made the best soldier "you or the Negros?" I told him they make the of guards and in reply he said "the Negro was superior to the Yankee and that all we ever knew we learned from them" … I told him that he could talk that to some men but not to me while doing my duty. He then said if I did not like his talk I could leave, at the same time drawing my revolver from its case…Lt. Dunlap stepped between us and told me to put up my revolver. I immediately did so. Lt. Dunlap taking Capt. Peyton by the arm to lead him off and I turned to go away. Capt. Peyton shaking his fist at me said I did not dare shoot and I was a coward. I immediately drew my revolver and told him I would, immediately upon
