United States Flag of 1864
When the Civil War (also referred to by some as "The War Between the States") began, the 33 star flag was the flag of the Nation. On January 29, 1861, Kansas joined the Union as the 34th state. As required by law, the 34 star flag became the official flag on next July 4th. During the war, two more states were admitted to the Union, West Virginia on June 20, 1863 and Nevada on October 31, 1864, making 36 the total number of states in the Union before the end of the war. At the time of the Battle of Averasboro, the 35 star flag was the Union flag, since the Nevada flag would not be added until July 4, 1865.
